1. Terms of Use
By accessing and using the PEAL Compliant website (pealcompliant.com) and any associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the site following any changes constitutes acceptance of those changes.
2. Service Description
PEAL Compliant provides food labelling compliance resources, tools, and services for Australian food businesses. Our offerings include digital compliance kits, label review services, educational resources, and consulting services designed to help food businesses meet their obligations under the Food Standards Code, including Plain English Allergen Labelling (PEAL) requirements.
Services are delivered digitally unless otherwise specified. The specific deliverables for each service tier are described on our pricing page and in your purchase confirmation.
3. Compliance Disclaimer
PEAL Compliant does not provide legal advice. Our services are designed to assist food businesses in understanding and implementing PEAL compliance requirements, but they do not constitute legal, regulatory, or professional food safety advice.
While we make every effort to ensure our resources are accurate and up to date with the current Food Standards Code, ultimate responsibility for food label compliance rests with the food business operator. We strongly recommend that businesses verify their labelling with their relevant state or territory food authority or seek independent legal advice where appropriate.
Our label reviews and compliance assessments are based on our professional understanding of PEAL requirements at the time of review and should be treated as guidance, not as a guarantee of regulatory compliance.
4. Per-Site Licensing Terms
All PEAL Compliant compliance kits and digital products are licensed on a per-site basis. One licence covers one physical business location or one online store. Businesses operating from multiple sites require a separate licence for each site.
Licences are non-transferable and may not be shared with, resold to, or used by any other business entity without prior written consent from PEAL Compliant.
5. Payment Terms
All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Payment is required at the time of purchase unless otherwise agreed in writing.
Payments are processed securely through Gumroad. We do not store credit card details on our servers. By making a purchase, you agree to Gumroad's terms of service. Gumroad handles all payment processing, VAT/GST collection, and delivery of digital products on our behalf.
5.1 Payment Plans & Instalments
Selected tiers offer instalment payment plans processed through Gumroad:
- Done-With-You Audit ($597): Available as 3 monthly instalments of $199 each. Full access to the kit and audit service is granted from the first payment.
- Done-For-You Compliance ($2,497+): Flexible payment plans are available and will be outlined in your service agreement prior to commencement.
If an instalment payment fails, Gumroad will attempt to re-process the payment according to its retry schedule. If payment cannot be collected after reasonable attempts, we reserve the right to suspend access to digital resources until the outstanding balance is resolved. Any work already completed and delivered remains yours.
5.2 Quick Label Check Credit
The $49 Quick Label Check fee is credited in full towards the purchase of any compliance tier (DIY Kit, Done-With-You Audit, or Done-For-You Compliance) made within 30 days of the Quick Label Check purchase date. The credit is applied at checkout and cannot be combined with other offers or redeemed for cash.
For service-based tiers that involve ongoing work (such as the Done-For-You tier), payment schedules will be outlined in your service agreement.
6. Refund Policy
Digital products: Due to the nature of digital products, all digital compliance kits, templates, and downloadable resources are non-refundable once accessed or downloaded. This is in accordance with Australian Consumer Law provisions regarding digital products.
Service-based tiers: For service-based offerings (such as label reviews, consulting, or done-for-you compliance services), a full refund is available if work has not yet commenced. Once work has begun, refunds will be assessed on a case-by-case basis, taking into account the work already completed.
Quick Label Check: The $49 Quick Label Check fee is non-refundable once the review has been completed and delivered.
7. Intellectual Property
All content on the PEAL Compliant website, including text, graphics, logos, templates, checklists, compliance kits, and other materials, is the intellectual property of PEAL Compliant and is protected by Australian copyright law.
Purchased compliance kits and templates are licensed for use by the purchasing business only. You may not reproduce, distribute, sell, or create derivative works from our materials without express written permission.
You may print and use purchased materials within your business operations as intended (e.g., printing checklists for your kitchen, using templates for your labels).
8. Limitation of Liability
To the maximum extent permitted by law, PEAL Compliant, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, products, or website.
Our total liability for any claim arising from the use of our services shall not exceed the amount you paid for the specific service or product giving rise to the claim.
We are not liable for any regulatory penalties, fines, product recalls, or other consequences that may result from your food labelling decisions, even if those decisions were informed by our services or resources.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
Nothing in these terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable legislation that cannot be excluded by agreement.
